Terms of Service

These Terms of Service (“Terms”) govern the use of the Meter Rider mobile application and related services provided by Meter Rider Technologies (“we”, “us”, “our”). By registering as a driver and using the app, you (“Driver”, “you”) agree to these Terms.

1. Service Description

Meter Rider is a driver-focused digital tool that helps auto rickshaw drivers manage rides, subscriptions, meter calculations, and related activities. Meter Rider does not directly provide transportation services to passengers and does not act as a transport company. You use Meter Rider to support your own independent driving business.

2. Eligibility

To use the app, you must:

  • Be at least 18 years old
  • Hold valid licenses and permits required to operate an auto rickshaw in your jurisdiction
  • Provide accurate and complete information during registration
  • Comply with all applicable local laws, traffic rules, and regulations

We may refuse or terminate access if these conditions are not met.

3. Driver Account

  • You are responsible for maintaining the confidentiality of your login credentials.
  • You agree to notify us promptly if you suspect unauthorized access to your account.
  • You must not share your account with other drivers or transfer it to another person.
  • All activity under your account will be treated as your responsibility.

4. Location Services and Real-Time Tracking

4.1. Consent to Track: By registering as a Driver-Partner on Meter Rider and toggling your status to "Online," you provide your explicit and informed consent for the App to collect, monitor, and use your real-time geographic location (GPS coordinates).

4.2. Background Location Access: You acknowledge and agree that Meter Rider requires access to your location data even when the application is running in the background or when the screen is locked. This background access is strictly necessary to:

  • Identify and notify you of nearby passenger leads and community requests.
  • Ensure the "Digital Meter" continues to calculate accurate trip distances and fares while you are navigating or using other apps.
  • Provide real-time safety monitoring for the duration of your "Online" session.

4.3. Purpose of Collection: Location data is collected solely for the purposes of service delivery, including but not limited to: accurate fare calculation, optimizing the driver network, providing proof of trip for dispute resolution, and enhancing the safety of the driver and the community in Tiruchirappalli.

4.4. Control and Withdrawal: You maintain total control over your visibility. You may withdraw your consent for real-time tracking at any time by:

  • Toggling your status to "Offline" within the App.
  • Closing the App session completely.
  • Revoking location permissions in your device settings (Note: This will disable the Digital Meter and lead-sharing features).

4.5. Data Sharing & Privacy: Meter Rider does not sell your location history to third-party advertisers. Your real-time location is only visible to the Admin and, where applicable, to other verified drivers within the network for the purpose of lead coordination. Historical trip data is stored securely and is only retained as long as necessary for regulatory compliance or dispute resolution.

5. Nature of Relationship

  • Meter Rider is a technology platform and does not employ drivers.
  • Nothing in these Terms creates an employer–employee, partnership, joint venture, or agency relationship between Meter Rider and drivers.
  • You operate as an independent service provider and are solely responsible for your interactions with passengers and compliance with law.

6. Use of the App

You agree to:

  • Use the app only for lawful purposes and in a manner consistent with these Terms
  • Not misuse or attempt to disrupt the app (for example, hacking, reverse engineering, spreading malware)
  • Not use the app to harass, abuse, or harm any person
  • Not falsify trips, manipulate GPS, or engage in fraudulent behavior

We may monitor usage patterns and suspend or terminate accounts that violate these Terms or show suspicious activity.

7. Fees and Gamification

7.1. Service Model: Meter Rider currently operates as a free-to-use utility. We reserve the right to introduce advertisements or subscription-based models in the future with prior notice.

7.2. Leaderboard & Points: Points earned for activity (Leads, Ride Completion, etc.) are for gamification purposes only. They have no monetary value, cannot be redeemed for cash, and are non-transferable.

7.3. Rewards: Monthly prizes or gift vouchers may be awarded to top-ranking drivers at our sole discretion. Our decision regarding point calculation, leaderboard ranking, and prize eligibility is final and binding. No correspondence will be entertained in this regard. We reserve the right to disqualify any driver suspected of fraudulent point manipulation.

8. Earnings and Taxes

  • Meter Rider does not guarantee any minimum number of rides, earnings, or income.
  • You are solely responsible for your earnings, pricing agreed upon with passengers, and all related taxes, fees, or levies required by law.
  • Meter Rider is not responsible for disputes between you and passengers regarding fares, behavior, or other issues.
  • The Digital Meter is a calculation tool. Drivers are responsible for ensuring fares charged comply with the prevailing government-approved RTO fare charts for Tiruchirappalli.

9. Intellectual Property

  • The Meter Rider app, logo, design, and all related content are owned by or licensed to Meter Rider Technologies and are protected by intellectual property laws.
  • You are granted a limited, non-exclusive, non-transferable license to use the app solely for your professional driving activities, subject to these Terms.
  • You may not copy, modify, distribute, or create derivative works from the app or its content without our written permission.

10. Suspension and Termination

We may suspend or terminate your access to the app, with or without notice, if:

  • You violate these Terms or applicable laws
  • You engage in fraud, abuse, or behavior that harms passengers, other drivers, or our reputation
  • Required regulatory or safety reasons arise

You may stop using the app and request account closure at any time. Certain data may be retained as required by law or for legitimate business purposes.

11. Disclaimers

  • The app is provided on an “as is” and “as available” basis.
  • We do not guarantee uninterrupted, error-free operation or availability at all times.
  • We do not guarantee any level of earnings or number of ride requests.
  • To the maximum extent permitted by law, we disclaim all warranties, express or implied, including fitness for a particular purpose and non-infringement.

12. Limitation of Liability

To the maximum extent permitted by law:

  • Meter Rider Technologies will not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits or income, arising from or related to the use of the app.
  • Our total aggregate liability for any claim related to the app or these Terms will not exceed the total subscription fees paid by you to Meter Rider in the preceding three months, or ₹500 (whichever is higher).
  • Meter Rider is not liable for any criminal acts, physical disputes, or illegal conduct by passengers or third parties. Drivers are advised to use their professional judgment and contact local law enforcement (100/112) for emergencies.

13. Indemnity

You agree to indemnify and hold harmless Meter Rider Technologies, its directors, employees, and partners from any claims, damages, losses, liabilities, and expenses (including legal fees) arising out of:

  • Your use of the app
  • Your interactions with passengers
  • Your breach of these Terms or any applicable laws

14. Changes to the Terms

We may update these Terms from time to time. When we do so, we will update the “Last updated” date at the top and may provide notice in the app or on the website. Continued use of the app after changes means you accept the updated Terms.

15. Governing Law and Dispute Resolution

These Terms are governed by the laws of India. Any disputes will be subject to the exclusive jurisdiction of the courts located in Tiruchirappalli, Tamil Nadu, India, unless applicable law requires otherwise.
